After 42 hearings spaced over 13 years, the Japanese Supreme Court finally rejected a damages suit filed by a group representing Korean victims of the Japanese imperial military`s atrocities during World War II. The verdict on Monday turning down the damages claim and ordering the plaintiffs to pay the litigation cost quashed the last hope for the 35 suitors, including six former "comfort women" for Japanese soldiers.

Ruling on the "damages suit for Korean victims in the Asia-Pacific War," the Japanese top court said that the government could not be held responsible for legal claims stemming from events that predate the nation`s 1947 constitution. It was the simplest conclusion that hardly required the tormenting testimonies of the victims and complex legal arguments over so long a time.

The Tokyo District Court had ruled that international law does not recognize individual damages claims against the state responsible for war, and the Tokyo Appellate Court later confirmed that the damages were officially settled in the 1965 Korea-Japan Rapprochement Treaty. The Japanese court has thus exempted its administration from responsibilities for the damages inflicted on individuals during the war and established a precedent to reject any similar claims from other victims of the war in Korea and other Asian countries.

The Korean plaintiffs argued the 1965 treaty just covered claims between the two governments and never cleared the Tokyo government`s responsibility for the suffering of individuals forced into the war, battlefield labor and sex slavery. Their legal actions failed to bring them monetary compensation but in the course of hearings, they exposed the wartime atrocities of the Japanese imperialists, contributing to the protection of truth against resurgent attempts at distorting history in Japanese society.

Japanese authorities have now been shielded from bearing responsibilities for the inhumanities of the past war with the help of dusted legal provisions and old theories, but the conscience of the people cannot be completely sealed from remembering the tragedies of war and sharing them with victims who are still alive.
